Driver Sustains Serious Neck Injuries
At approximately 11 p.m., Dominick T. was operating a tow truck northbound on Route 9 in Lacey Township, New Jersey. When he reached the intersection of Bay Avenue, a vehicle driven by Derek M. disregarded the stop sign and struck the tow truck. The impact caused the tow truck to slide into the southbound lane of Route 9 and strike another vehicle, which was traveling southbound, head-on.
As a result of the accident, Dominick sustained a significant injury to his neck that ultimately required surgery consisting of an anterior cervical discectomy with fusion of C5-6.
Unfortunately, the vehicle driven by the defendant, Derek M., was uninsured on the date of the accident. Through diligent discovery of Gabriel R. Lependorf, Esq., it was determined that there was a policy of insurance through the tow-truck company that would compensate Dominick for his loss.
The case finally was brought to conclusion by way of binding arbitration where the arbitrators awarded Dominick $675,000. This figure, coupled with the funds that Mr. Lependorf’s partner David E. Silverstein, Esq. was able to secure in worker’s compensation court, brought the total award to just over $900,000.
