LEGAL REPRESENTATION FOR BIKE ACCIDENT INJURIES

David Silverstein NJ Bicycle Accident Attorney

Bicyclists have just about the same rights to the road as motor vehicle drivers, but unlike the occupants of cars, trucks, and buses, bicyclists have little protection against the force of an accident. In fact, the only protection a typical bicycle rider has is a helmet, and that may not be enough to prevent injury in a serious crash.

Other motorists, as well as bicycle manufacturers and roadway agencies, are partially responsible for the safety of bicyclists. If their negligence results in an injury to a bicyclist, they may be held liable for the losses the bicyclist suffers.

At Lependorf & Silverstein, P.C., our New Jersey bicycle accident lawyers are committed to obtaining justice for our clients. We have the skills and resources necessary to get you any compensation you deserve, so call us for a free consultation about your case.

MOST COMMON INJURIES RESULTING FROM A BIKE CRASH

The injuries sustained in a bicycle crash can vary, from minor cuts and abrasions to severe head trauma. Bumps, scrapes, and bruises are painful and inconvenient, but are easily recovered from. Unfortunately, the majority of bicycle accidents result in far more serious injuries, such as:

  • Head injuries: Skull fracture, concussion, brain contusion, and intracranial hemorrhaging occur in up to 47% of all bike-related accidents. A head injury can result from a vehicle hitting the bicyclist’s head, or from the bicyclist landing on the ground or other surface. Wearing a helmet will protect a rider from penetrating head injury and some skull fractures, but it does not eliminate the potential for all brain injuries. Long-term issues can include muscle spasticity or pain, headaches, migraines, and intense fatigue. Riders may also suffer cognitive impairment, which can include memory problems, reduced thinking speed, inability to multitask, confusion, reduced attention or ability to concentrate, increased anxiety, and mood swings.
  • Musculoskeletal injuries: Broken bones, dislocations, and strains to the extremities are very common injuries sustained by bicycle riders. Most of these injuries can heal with medical care and time. More serious damage can require surgery and therapy to recover full function. Diminished mobility and long-term pain can result from severe musculoskeletal injuries.
  • Facial and eye injuries: Lacerations, contusions, and fractures to the face occur when the face makes impact with a hard surface. Scarring is the most common long-term result from facial trauma, but it can often be corrected with expensive surgery. Airborne objects, such as debris created during the accident, are the greatest culprits of injury to the eye. There is a potential for lasting vision impairment from a bicycle accident, which will change a rider’s life immeasurably.
  • Road rash: Serious abrasions, which peel away layers of skin while the bicyclist slides along the pavement, are called road rash. It’s a commonly known issue for motorcyclists, and it can cause just as much trouble for bicyclists. Road rash ranges from first degree (minor, first layer of skin affected) to third degree (severe, may expose muscle, tendons, bone), and is at serious risk of infection – as well as being very painful. Scarring may also result, and in extreme cases, amputation may be necessary.
  • Spinal cord injuries: Spinal cord injuries are almost always serious. In addition to damage to both hard and soft tissue in the back and neck, damage to the spinal nerves will present long-term issues to a bicyclist. A “complete” spinal injury means that the rider will have total lack of motor or sensory function below the site of the injury. An “incomplete” injury means that the rider will have some motor or sensory function below the injury site. However, both injuries will have a permanent impact on many aspects of the rider’s life.

HOLDING AT-FAULT PARTIES ACCOUNTABLE

A variety of factors may contribute to a bicycle accident, which may make determining fault complicated. Did the bicyclist violate any traffic laws? Was the motorist negligent or reckless in any way? Was the bicyclist trying to avoid a hazardous road condition? Did a bike defect cause the cyclist to lose control?

Whether the cause of the crash was one or a combination of these situations, a skilled attorney will find the answers in order to ensure a successful personal injury claim.
