Did You Crash Because of Another Person in Middlesex County?

David Silverstein NJ Bicycle Accident Attorney

A bicycle accident can cause injury easily, because bicyclists have no protection surrounding their bodies. When the collision involved a motor vehicle, catastrophic injuries are even more likely.

If you have been the victim of a bike crash and want to understand your legal rights, call (609) 240-0040 to schedule a free consultation with the South Brunswick personal injury lawyers at Lependorf & Silverstein, P.C.

Bicycle Laws Safety Tips

Bike Laws in New Jersey

All bike riders are required to follow the laws that apply to other motor vehicles on the road. You are also entitled to the same rights as other vehicles. However, there are other laws that only apply to bike riders, such as the requirement to ride as near to the right side of the road as possible while still exercising reasonable caution. In addition, all bicyclists under 17 years old are required to wear a DOT-approved helmet when riding on a street open to motor vehicles.

In South Brunswick, we’ve seen many motorists fail to yield the right-of-way to bicyclists, and pass bicyclists without leaving enough space between the bike and the car. Bicyclists need to be vigilant, but they can’t prevent all accidents.

Determining Who Is at Fault

Download After a Bike Accident Book

In some cases, it is easy to determine who caused a South Brunswick bike accident, but in other situations, it can be more complex. If a driver was negligent in operating his 4,000-pound vehicle, he will probably be held responsible for the accident and compensation for the victim.

There are, however, a few other parties who could be liable for a bicycle collision. If damage to the roadway or an obstruction caused the accident, then the city, state, or municipality responsible for road maintenance could be liable. The same could be true if there was no warning sign for a dangerous curve, a blind corner, or even a substantially narrower section of roadway.

If the accident was caused by a defective part on the bike, defective construction, or a malfunction of any part of the bike, a manufacturer or mechanic might be responsible for compensating the injury victim.
