COLLECTING DAMAGES ON A NJ MOTORCYCLE ACCIDENT WRONGFUL DEATH CLAIM

NJ Deadly Motorcycle Accident LawyersPriority for wrongful death damages in New Jersey is given to the heirs and dependents of the deceased, such as spouses, children, parents, and siblings. They may receive compensation for the following losses, if the jury deems it:

  • Medical and funeral expenses
  • Loss of financial support
  • Loss of household services
  • Loss of companionship

Emotional distress is not compensable under the Wrongful Death Act but may be compensable through a tort action for the negligent infliction of emotional distress. However, the following circumstances must be present for the tort action to be considered valid: the defendant’s negligence led to the death of the decedent, the plaintiff and the decedent shared an intimate marital or familial relationship, and the plaintiff has been inflicted with severe emotional distress from witnessing the death.

MOTORCYCLE ACCIDENT FATALITIES AND PREVENTION

Motorcyclists are much more vulnerable than drivers of other motor vehicles. In fact, they are 35 times more likely to die in an accident than drivers of passenger vehicles. However, a motorcyclist can significantly reduce his or her chances of dying in an accident by wearing a helmet. In 2009, approximately 44 percent of all motorcyclists who experienced fatal accidents were not wearing a helmet at the time. According to the National Highway Traffic Safety Administration (NHTSA), many of their lives were needlessly lost, since hundreds of them could’ve survived if they only wore a helmet.

In addition to wearing proper protective gear, motorcyclists can prevent an accident by practicing the following safety guidelines:

  • Never drink and ride your motorcycle. Alcohol greatly impairs coordination and reaction, making drunk motorcycling extremely dangerous. If you are inebriated, have a sober friend give you a ride or take a taxi.
  • Avoid tailgating. The motor vehicle in front of you may suddenly stop, forcing you into a precarious, even deadly situation.
  • Avoid lingering in blind spots. Drivers of passenger vehicles already have a harder time seeing motorcycles than other motor vehicles.
  • Relax, but stay cautious at the same time. Do not get nervous and tense up your body. This will only tire you out. However, do regard your surroundings with great care and don’t trust any motorist to make the right move.

Unfortunately, even if a motorcyclist rides safe, he or she is still susceptible to his or her environment, and one false move from a negligent motorist can extinguish a life in an instant.
