Colts Neck, NJ (November 14th, 2021) – On the early morning hours of Sunday, November 14th, 2021 officers from the Colts Neck responded to a traffic accident involving a single-vehicle that happened on the southbound lanes of Highway 18, near Milepost 20.8.
According to responding officers, a preliminary investigation indicated that a driver, a female resident from Seaside Heights and a passenger, a male resident from Edison, were heading south on Highway 18. Once the duo neared the milepost, their vehicle, a Mazda, veered off the road and collided into a tree. Consequently the vehicle overturned ending in a culvert.
The passenger suffered catastrophic injuries. He was pronounced dead at the scene. The female driver suffered serious bodily harm and was rushed to a hospital. The injuries she sustained were not considered life threatening. The driver is reportedly in stable medical condition.
Officers continue investigating the cause of the accident. The identities of those involved have not yet been revealed. Anyone with information regarding the accident is asked to contact the police department.
In New Jersey, there are many different types of traffic accidents. Among these accidents, single-vehicle accidents are some of the most deadly. Even when a person survives a single-vehicle accident, the consequences can be catastrophic and life-changing.
Single-vehicle accidents can be caused by a number of factors, such as inclement weather, insufficient street lighting, other drivers, dangerous roads, or even defective vehicle parts. No matter the cause of the accident, when the accident was caused as a result of another party, the negligent party may be held accountable for the victim’s injuries and losses.
The State of New Jersey is a no-fault state, meaning it is not necessary to demonstrate negligence to obtain compensation for the injuries resulting from an auto accident. In a single-vehicle accident, the injured party can receive compensation from his or her own auto insurance company even if he or she is responsible for causing the accident.
Unfortunately, the costs of certain injuries can surpass the benefits offered by the insurance company. Some of these injuries can include the loss of a limb, traumatic brain injury, permanent disability, and the loss of sight. In these situations, it is absolutely necessary to pursue a claim against the at-fault party.
Regrettably, obtaining financial compensation from the at-fault party is not as easy as seeking compensation from the Personal Injury Protection insurance program. While obtaining compensation from the Personal Injury Protection program does not require the need to prove liability, in these cases, it is necessary to demonstrate the at-fault party’s negligence. The new case will need to establish that the negligence led to the accident which caused the victim’s injuries.
When the single-vehicle accident is caused as a result of a municipality or town, further restrictions may apply. Single-vehicle accidents that are caused as a result of poor road conditions or overgrown brush, the town responsible may be held accountable as a result of the state’s Tort Claims Act. When filing the claim against the public agency, it is important to notify the agency of the case within 90 days.
Single-vehicle accident cases are very complex and there are a plethora of factors to consider. Fortunately, the support of a proficient attorney can be obtained, which will ensure the case is thoroughly investigated and all at-fault parties are held accountable. A skilled litigator will ensure the highest compensation available is obtained.
If you or a loved one was recently hurt in a single-vehicle accident, it is important that you take immediate action and seek the legal guidance of an experienced personal injury attorney who has experience in the matter. Whether the accident was caused by poorly maintained roads, vehicle defects, or another driver, a well-versed attorney will ensure the responsible party is held accountable for the negligence.
