Traffic accidents remain one of the leading causes of serious injuries in the State of New Jersey. The state’s Department of Transportation reports that in 2019, there were more than 276,000 traffic accidents. Sadly, a vast majority of these accidents resulted in catastrophic, even life-changing injuries.
In New Jersey, speeding is one of the most common factors in deadly traffic accidents and intoxication was a factor in almost one-fourth of all deadly accidents. A final contributing factor that is common across all fatal traffic accidents is distracted driving. It is important that drivers are aware of these frightening statistics as they promote safe driving.
A majority of traffic accidents in New Jersey are evidently caused by driver error and this can include any of the previously mentioned factors but they can also include driving while sleep-deprived, aggressive driving, and reckless driving. Although many accidents are primarily caused by human error, it is important to recognize that some accidents can also be caused as a result of a failure in the vehicle’s performance.
Vehicle technology is continuously developed and improved and with every improvement, vehicle makers and their safety experts aim to save the lives of their drivers and passengers in the event of an accident. Vehicle manufacturers strive to protect people by enhancing airbag deployment and providing blind-spot alerts on newer models. Unfortunately, these companies are not immune from mistakes and even intentional wrongdoing.
Traffic accidents can be caused when an automaker releases a vehicle that is defective in its design or when a vehicle is not assembled in the way it was meant to. Faulty vehicle designs and errors made while on the production line can be detrimental to the safety and well-being of consumers. Sadly, these errors can be life-changing for auto accident victims and their families.
When a vehicle manufacturer or maker is responsible for a preventable accident that resulted in the serious injury or death of an innocent person, the negligent party should be held responsible for the victim’s financial losses. Possible compensation obtained from these parties can include but is not limited to hospital bills, pain and suffering, loss of employment, and disability.
If the accident resulted in the death of the victim, the victim’s family may be eligible to seek compensation on behalf of the deceased through a wrongful death claim. Wrongful death claims can also provide compensation for the expenses accrued prior to the victim’s passing, but the plaintiffs in a case cannot recover emotional suffering.
Sadly, far too many car accident victims fail to recover the full extent of the available compensation. Although monetary compensation will do little to help ease the emotional aftermath of a catastrophic accident, receiving sufficient financial aid can be a tremendous help in a person’s recovery. When a person is injured in a car accident, the injury can be deeply complex, which may lead to the need for long-term medical care. Without the right professional assistance, a victim and his or her family may be low-balled in a financial settlement.
If you or someone you love was recently hurt in a traffic accident in New Jersey, whether the accident involves a motorcycle, large commercial truck, regular passenger vehicle, or other motor vehicles, it is important to take immediate action and seek the support of an experienced personal injury attorney.
A personal injury attorney with the right skills and experience will ensure that the case is fully investigated and all important evidence is collected and safeguarded.
In addition, a proficient litigator will ensure the case is filed within New Jersey’s statute of limitations for traffic accidents. Car accidents in New Jersey have to be filed under a specific time frame in order to be valid. In most cases, the state allows only a two-year window for an injured person to file a claim.
Lastly, a well-established attorney will fight for your right to full compensation. Insurance companies and at-fault parties will do all that is possible to deny an injured sufficient compensation. With the right legal representation, a victim can recover the highest compensation available.
