This isn not the first time Dunkin’ Donuts has been sued for hot coffee injuries, and in 2022 alone, the company was sued seven times in the state of New Jersey for similar incidents. One plaintiff is also suing the company that manufactures Dunkin’ Donuts’ lids – Dart Container Corporation. This is the largest manufacturer of foam cups in the world, and the implication is that their lids are inherently faulty. Walmart Wins Lawsuit Over Motorized Cart Injury

 In December of 2022, Walmart managed to avoid consequences for allegedly causing a shopper’s injuries with its motorized carts. The plaintiff claimed that another shopper crashed into her with a motorized cart, causing her to suffer serious injuries. The lawsuit claimed that Walmart should have never provided customers with such dangerous items with such a high potential for injuries.

However, a judge took Walmart’s side, stating:

“Generally, merely providing shopping carts as self-service equipment does not alone increase the risk of a dangerous condition to warrant application of the mode of operation rule.”

The mode of operation rule mostly applies to how businesses – like Walmart – display items. For example, a stack of cereal boxes might be piled so high that customers cannot see around corners. Another example would be a fruit display that has a high probability of spilling onto the ground – thereby causing a slip hazard.

NutriNinja Sued for Explosion Injury

 On February 3, 2023, it was reported that a woman from New Jersey was suing NutriNinja. She was allegedly using her NutriNinja blender when it exploded. The blade then detached, causing a serious injury risk. The lawsuit claims that this blender’s design causes the contents to become extremely hot. This heat then creates pressure inside the cup component. When this pressure reaches a certain point, it can cause the blade to separate from the blender, resulting in an explosion that causes hot substances – including food matter and blade fragments – to spray outwards. The lawsuit claims that this injury risk was never disclosed by NutriNinja.
