Fall into a Sinkhole Behind Apartment Complex

Lependorf & Silverstein, P.C., obtained a settlement of $2.3 million for a young Middlesex County woman who suffered injuries at her apartment complex. Pursuant to the terms of the settlement, which was reached after a day of mediation with a retired Essex County superior court judge, the identities of the parties are to remain confidential.

The firm’s client was walking her dog behind her apartment complex when she fell in a hole, injuring her right knee. The knee required surgery and ultimately led to a condition known as RSD, a very painful nerve disorder. The hole was covered by snow and the apartment complex claimed that it was a sinkhole and the danger could not have been known to them prior to the occurrence. Lependorf & Silverstein, P.C., employed experts to refute this lack of knowledge. With a trial date on the horizon, the apartment complex was not willing to take a chance with a jury and the settlement was finalized.
