Legal Representation for Families in Mercer County

Mercer County is New Jersey’s capital county and is home to 366,000 people. As a bustling center for education, culture, and commerce in the state, Mercer County has everything: universities, such as Princeton, office buildings, shopping centers, residential neighborhoods, restaurants, historical sites, as well as quite a few major highways and commuter rail and light rail systems. Unfortunately, as with any major metropolitan area, accidents are common. While many of these accidents cause injury, there are also tragic incidents that result in the death of innocent people; and these accidents may have been prevented.

There is nothing more devastating than losing a loved one as the result of another’s negligent or reckless actions. At Lependorf & Silverstein, P.C., our Mercer County injury attorneys are committed to helping grieving families get justice and rightful compensation for the wrongful death of their loved one. If you’re family has suffered as the result of another’s negligence, call us today at (609) 240-0040 to find out about your legal rights and options.

New Jersey Wrongful Death Laws

Filing a wrongful death claim can help you and your family get the closure and financial compensation you need to put your lives back together after such a tragic event. The first step in deciding whether or not you want to take legal action is determining whether it is even possible.

According to New Jersey Permanent Statute 2A:31-1, when the death of a person is caused by a neglect, wrongful act, or default (mistake) that would have given the victim the right to file a personal injury claim should the death not have occurred, then their family can file a wrongful death claim on their behalf.

Grounds for Filing a Wrongful Death Claim in Mercer County

The above law granting grieving family members the right to hold at-fault parties responsible for the death of their loved one is fairly straightforward, if you are familiar with the common incidents that are considered “a wrongful act, neglect, or default.” While not a complete list, if your loved one’s fatal accident was caused by any of the following, you may have grounds for taking legal action:

Statute of Limitations

New Jersey law limits the amount of time that you have to file a wrongful death claim, so it is not a decision to wait too long to make. Any action brought against another for the wrongful death of a loved one must be started within two years after the death. It is okay if it is started before the two years are up, but it then carries over into the next year.
