REPRESENTATION FOR PEOPLE INJURED ON MOTORIZED BIKES AND SCOOTERS
Mopeds offer a unique method of transportation without the full commitment of a motorcycle or car. When operated properly, these vehicles are a good option for people who are not old enough to drive or those who do not want a larger motor vehicle. Caution must be used by anyone driving a moped, however, as they lack the protections afforded by cars, trucks, and SUVs.
That means other drivers on the road need to be cautious when approaching, passing, or otherwise driving near people on mopeds. Careless drivers who strike people on motorized bicycles or scooters can cause catastrophic injuries.
If you or a loved one has been injured while operating a moped, please know you have legal options. Call Lependorf & Silverstein, P.C., at (609) 240-0040 and take action against whoever harmed you.
MOPEDS AND MOTOR SCOOTERS
Mopeds are similar to a lot of other vehicles, but unique in ways that make them both fun and potentially dangerous. In general, these vehicles look like a bicycle or a scooter; in fact, bike versions typically have pedals just like a bicycle. The major distinction is these vehicles also have a motor, allowing them to travel faster than vehicles propelled by the driver’s feet, but not as fast as something like a motorcycle.
Since mopeds have an engine, they are considered motor vehicles in New Jersey, and are subject to the same traffic laws as any other motor vehicle in the state. You cannot operate a moped on a sidewalk or other area reserved for pedestrians, and must always go with the flow of traffic while operating your vehicle on the street.
LAWS AND REGULATIONS FOR MOPED USE IN NEW JERSEY
In addition to following the general motor vehicle laws of New Jersey, moped users must also follow certain restrictions specific to them. Moped operators must be at least 15 years old in New Jersey, and must have either a special moped license, a motorcycle license, or a basic driver’s license. Since the engines on these vehicles are weaker than those on even small motorcycles, passengers are not allowed on mopeds.
Anyone driving a moped must also wear an appropriate helmet at all times. Full-face helmets are recommended by the State of New Jersey, though any approved helmet that covers the head is appropriate. Wearing a helmet is the most important thing a moped driver can do to stay safe. Collisions with another vehicle, or even single-vehicle moped accidents, can be disastrous for someone not wearing a helmet.
SERIOUS INJURIES FROM MOPED ACCIDENTS
Drivers of mopeds and motorized scooters lack the protective encasing of cars and trucks, and they are exposed to danger. Even something as simple as falling over while going at a low speed can cause painful injuries that require medical attention. A collision with a larger motor vehicle can be catastrophic, even fatal.
Some common injuries from moped accidents include:
- Bruises and scrapes, including road rash
- Deep lacerations
- Broken bones
- Soft tissue damage
- Internal injuries
- Neck and shoulder injuries
- Spinal cord damage
- Traumatic brain injuries
