Injured Due to Violations of U.S. Occupational Safety and Health Administration (OSHA) Rules
The U.S. Occupational Safety and Health Administration (OSHA) is the agency charged with setting and enforcing standards to assure safe and healthful working conditions, pursuant to the Occupational Safety and Health Act of 1970. Employers all over the country in virtually every industry are required to comply with these regulations, and violations are subject to citations, fines, and other penalties.
Unfortunately, employers may fail to comply with OSHA safety standards, and in some cases, the result of their negligence is that workers get hurt. When this happens, the best thing to do is to speak with a knowledgeable work injury attorney. You may have options under the law that allow you to pursue compensation for your injuries.

Reporting OSHA Violations
Under the Occupational Safety and Health Act, workers have the right to file a complaint with OSHA regarding employer violations and request an inspection of their workplace. This should be done as soon as possible after you become aware of a workplace hazard, as OSHA can only issue citations for current violations and violations that have occurred within the past six months.
Even if you are not filing a complaint, you can call OSHA at 1-800-321-6742 to report safety and health violations, unsafe working conditions, and emergencies. You can also contact OSHA by email or U.S. mail.
Compensation for Injuries Caused by OSHA Violations
In most cases, employees are covered for on-the-job injuries by workers’ compensation insurance. Workers’ comp covers medical expenses, partial reimbursement for lost wages, and certain other benefits. However, it may not be sufficient to fully compensate a worker who has been seriously or catastrophically injured because of employer negligence in maintaining safety regulations.
Workers’ compensation is designed to provide benefits for injured workers and to protect employers from lawsuits. However, the New Jersey Supreme Court has ruled, in cases of serious injury after employer violation of OSHA safety standards, that our state workers’ compensation statute does not provide immunity from liability for employers.
If your employer violated OSHA regulations, creating hazardous working conditions that caused you serious injury, you may have a valid claim for compensation for the losses you have suffered in a court of law. Your damages may include past and future medical expenses, lost wages, lost future earnings, pain and suffering, and other losses.
