Types of Workers’ Comp Benefits

Workers’ compensation is a no-fault insurance system that covers certain costs related to on-the-job injuries in New Jersey. In order to qualify, a worker’s injury must be “arising out of and in the course of” his or her employment, and the worker must be employed by an employer required to purchase workers’ compensation insurance in New Jersey.

Benefits that workers’ compensation provides include the below:

• Payments for medical bills related to the injury. These include the costs of emergency services, surgery, hospitalization, and prescriptions, if the worker needs these. The employer generally may choose the physician, unless an emergency exists or the employer refuses to provide medical treatment.
• Temporary total disability benefits to cover part of a worker’s lost wages if he or she cannot work for more than seven days. These benefits are generally capped at 70 percent of a worker’s average weekly wage, but they cannot go above 75 percent of the statewide average weekly wage – or below 20 percent of the statewide average.
• If a worker suffers a permanent, partial disability, permanent partial disability benefits are available. These are frequently paid in situations where an accident or injury results in the loss of some body part or function – for instance, when a worker loses a finger in a machinery accident. These benefits begin when temporary total disability benefits end.
• If you are unable to work at all, permanent total disability benefits may help you meet the costs of daily living. These are initially granted for 450 weeks, but may be renewed if you are still unable to work.
